Cindy Brown, owner of F&B, reportedly filed a complaint with the Superior Court of Fulton County earlier this month after restaurant “AF+B” announced it would open down the street in the Buckhead Atlanta development.

Brown told What Now Atlanta (WNA) earlier this year she was concerned the yet-to-open eatery would cause brand confusion given its close proximity to F&B.

“We have worked very hard to create and maintain our reputation in the marketplace,” Brown said. “Other people may undoubtedly confuse us with them.”

WNA got its hands on a letter from Fish and Richardson P.C., the legal firm for “AF+B,” citing the restaurant would open under a different name “to avoid our clients from having to incur unnecessary legal expenses.”

“Our client is actively considering alternate names, and gives its assurance that it will not open its Buckhead location under the AF+B name,” according to the letter.
