Critical Food Safety Violations Exposed at Two Metro Atlanta Restaurants

One Duluth city restaurant and a Lawrenceville restaurant failed the health inspections conducted by the GNR health department in Metro Atlanta on February 10. Murray’s In A Hurry was given 64 points at the end of the inspection when the required minimum to pass was 70. The Lawrenceville Burger King was able to score only 68 points. The inspectors observed several risk factor violations at the restaurants, for which they were given an Unsatisfactory “U” grade.

Located at 3940 Peachtree Industrial Blvd, #K, Murray’s In A Hurry serves Pizza, Sandwiches, Burgers, and more. The health department inspected the establishment on Monday afternoon. After observing various non-compliances, the inspectors gave the restaurant an unsatisfactory grade.

The report starts by stating that the various violations observed at the restaurant result from the person in charge’s lack of managerial control. As this individual is responsible for ensuring compliance with the food code, the report held them accountable for the issues at the restaurant.

Another violation was noted when an employee was seen returning to the kitchen and going straight to wearing gloves and handling the food without washing their hands. It was also noted that the front hand sink did not have paper towels and hand soap. Inspectors also saw the staff rinse the cutting board and place it clean without sanitizing it first.

One repeat violation was also observed at the restaurant. Multiple employees were seen handling food without proper hair restraints, and the person in charge was seen handling food without a beard net. Since this is the second consecutive violation of the same food code, the permit may be suspended if it is observed a third time.

Inspectors also saw that multiple time/temperature controls for safety foods were not stored at cold enough temperatures. The temperatures in the main reach-in cooler in the kitchen were also too high to store foods.

There was heavy residue on floors in the dry storage area and behind equipment in the kitchen.

Floor tiles in the ware wash area were seen to have been broken. There were no test strips for the chlorine and Purell sanitizers used at the facility.

Almost all the issues mentioned in the report were solved on the spot during the inspection. However, the problems concerning the PIC’s lack of control and the hair restraints for the employees are to be solved by February 20.

The health department will conduct the follow-up inspection at the restaurant on or before February 20. If the violations are not corrected by them, their permit maybe suspended. An additional required inspection will be conducted on or before February 20, 2026 as well.

The restaurant located at 544 W Pike St failed the inspection on Monday morning after several violations were observed by the inspectors. The inspection was a joint inspection with the Restaurant Development & Management (DMG) department.

The report begins by stating that the Certified Food Safety Manager Certificate (CFSM) was posted anywhere in the restaurant for public view. Inspectors also observed personal beverages in unapproved containers on the prep table in the kitchen. Clean ice buckets were seen to be stored on top of the handwashing sink. An accumulation of refuse was also observed next to the dumpsters.

Two repeat violations were observed at the restaurant. The first was the Person in charge not being able to demonstrate in a verifiable manner that employees were aware of their responsibility to report specific symptoms and illnesses. 

Another repeat violation was when the open liquid eggs were seen to be placed on time control without labels to indicate the start or discard time. The person in charge was not able to provide full written procedures for time control either. If a third consecutive violation of the same food code provisions on a routine is observed on an inspection, it will result in a permit suspension.

In cases of improper food storage, frozen raw chicken products that were removed from their original packaging were seen stored with frozen biscuits and frozen hashbrowns in the standing freezer. Frozen raw chicken in an open box was also seen to be stored above frozen raw fish in an open box in the walk-in freezer.

Most of the issues mentioned in the report were solved on-site, while the remaining are to be solved before the follow-up inspection. The follow-up inspection at the restaurant will occur within 10 days. There will also be an informal inspection that will occur on February 20 to verify that garbage disposal has been done. 

A required additional routine inspection shall also be conducted within 12 months. The report notes also instruct that dining counters, tabletops, and food trays are to be cleaned and sanitized routinely.

Inspectors visited 20 establishments under the Food 2023 code in the Gwinnett, Newton & Rockdale Counties on February 10. Out of them, 5 managed to score a perfect 100, and 7 scored above 90 or more points – all of them securing the “A” grade. Six of the establishments scored 80 plus and got a “B” grade.
